Terms and conditions - Lucky Bite Bag Promotion

1. Promoter and promotion period

1.     The promoter is Eve's Sweets Pty Ltd trading as Poppy's Chocolate, ABN 75125817898, of 5/2 Spanns Rd, Beenleigh, QLD, 4207, Australia (Promoter).

2.     These terms and conditions apply to the Lucky Bite Golden Pie promotion (Promotion). By purchasing a Lucky Bite bag and taking part, you agree to these terms.

3.     The Promotion starts at 6pm AEST on 13^th October 2026 and ends at the earliest of: (a) when all Lucky Bite bags have been sold; (b) when all 5 prizes have been claimed and allocated; or (c) 11:59pm AEST on 30 November 2026 (Promotion Period).

4.     Golden Pies must be claimed by 11:59pm AEST on 15 January 2027, whenever the Promotion Period ends (Claim Deadline).

5.     All times in these terms are Queensland time (AEST, UTC+10).

2. Eligibility and how to enter

1.     The Promotion is open to residents of Australia, excluding SA. SA Residents will not be eligible for any prizes.

2.     Employees of the Promoter, their immediate families, and anyone involved in producing, packing or running the Promotion are not eligible to claim a prize.

3.     Entrants under 18 may take part, but a parent or guardian must make the claim on their behalf and accept the prize.

4.     To enter, purchase one or more Lucky Bite bags during the Promotion Period from poppyschocolate.com.au / the Poppy's Chocolate factory store. There is no separate entry fee. Lucky Bite bags are sold at or below the average normal retail price of the pies they contain, and multi-bag packs are sold at a discount.

5.     Each Lucky Bite bag contains one pie. Customers cannot choose which pie they receive.

6.     Orders that are cancelled, refunded or subject to a chargeback are not eligible, and any Golden Pie found in them cannot be claimed.

3. Golden Pies and how winners are determined

1.     A total of 2,000 Lucky Bite bags will be produced. Five (5) of these bags contain a Golden Pie and a Golden Ticket. The chance of any one bag containing a Golden Pie is 1 in 400.

2.     Golden Pies are placed among the bags at random before the bags are sealed, so that every bag has an equal chance of containing one. The Promoter will not knowingly direct a Golden Pie to any particular customer, order or sales channel.

3.     Each Golden Ticket carries a unique code. Only a genuine Golden Ticket issued by the Promoter can be used to claim a prize. Copied, altered, damaged beyond recognition or forged tickets are invalid.

4.     Finding a Golden Pie and Golden Ticket entitles the finder to one prize. Which prize they receive depends on the order in which valid claims are received (clause 4).

5.     Keep your Golden Ticket and Golden Pie packaging until your prize is delivered. The Promoter may ask to see the original ticket before releasing a prize.

4. How to claim a prize

1.     To claim, email goldenpie@poppyschocolate.com.au before the Claim Deadline with:

a.     a clear photo of your Golden Pie and Golden Ticket, with the ticket code visible;

b.     your full name, phone number and delivery address; and

c.     your order number (or proof of purchase if bought in store).

2.     Claims are ranked in the order they are received at goldenpie@poppyschocolate.com.au, as shown by the time stamp on the Promoter's email server. The order is not based on when your Lucky Bite order was placed, paid for, dispatched or delivered.

3.     A claim is only ranked once it is complete. If a claim is missing any item in clause 4.1, its place is set by the time the missing information is received.

4.     Claims made by any other method (social media, phone, other email addresses, in store) will not be accepted.

5.     The Promoter will reply to each valid claim to confirm the claimant's position and list the prizes still available.

6.     First come, first served. The first valid claimant chooses from all 5 prizes. The second chooses from the 4 remaining, and so on. The fifth valid claimant receives the last remaining prize. There is only one of each prize.

7.     24-hour selection window. A claimant has 24 hours from the time of the Promoter's reply to email back their choice of prize.

8.     If a claimant has not replied within 24 hours and another valid claimant is waiting, the next claimant will be offered their choice. The late claimant may still choose from whatever prizes remain when they reply. If no other claimant is waiting, the late claimant's choice stays open until the next valid claim is received.

9.     The Promoter may verify any claim, including the ticket code, proof of purchase and identity, before allocating a prize. The Promoter may disqualify any claim it reasonably believes is fraudulent or breaches these terms.

10.  The Promoter's decision on the order of claims and the validity of any claim is final, and no correspondence will be entered into.

5. Prizes

1.     There are 5 prizes in total, with a total prize pool value of $2,977.00 (incl. GST). There is only one of each prize. Values are the recommended retail price at the time these terms were written.

2.     The Poppy's Chocolate voucher can be used at poppyschocolate.com.au and the factory store, expires on 31^st January 2027, and cannot be redeemed for cash. Any unused balance can be carried over to a later order but still needs to be used by expiry date.

6. Delivery of orders and courier delays

1.     Delivery times for Lucky Bite orders vary with location, shipping method, courier performance and other events outside the Promoter's control. Customers who buy in store may open their bags sooner than online customers.

2.     Because claims are ranked by the time the claim email is received (clause 4.2), when your order arrives may affect your place in the claim order. Receiving your order early is part of the luck of the Promotion.

3.     The Promoter is not responsible for any courier, postal or delivery delays, lost or damaged parcels, or the effect of any delay on a claimant's position or prize choice.

4.     The Promoter will not change the claim order, reserve a prize or offer compensation because of the time an order took to arrive.

7. Prize conditions and unclaimed prizes

1.     Prizes will be delivered free of charge to a physical address in Australia (excluding SA) within 28 days of the prize being selected. The Promoter is not responsible for a prize once it has been handed to the courier, except as required by law.

2.     Prizes are not transferable and cannot be exchanged or redeemed for cash.

3.     If a prize becomes unavailable, the Promoter will substitute a prize of equal or greater value.

4.     Manufacturer warranties apply to prizes. The Promoter gives no warranty of its own beyond those required by law.

5.     Unclaimed prizes. If fewer than 5 prizes have been validly claimed by the Claim Deadline, the remaining prizes will be awarded in an unclaimed prize draw at 5/2 Spanns Rd Beenleigh at 12pm AEST on 20^th January 2027. Every Lucky Bite bag purchased during the Promotion Period will count as one entry. Winners will be drawn at random and contacted by email and phone within 2 business days, and must claim their prize within 7 days.

6.     Winners may be responsible for any tax that applies to their prize. They should seek their own advice.

8. General

1.     Privacy. Personal information collected in this Promotion is used to run the Promotion, verify claims and deliver prizes. It will be handled under the Promoter's privacy policy. It will not be used for marketing unless the entrant has separately opted in.

2.     Publicity. With a winner's consent, the Promoter may publish their first name, suburb, photo or unboxing video in Promotion announcements, including in the Poppy's Chocolate Magic Society.

3.     Social media. This Promotion is not sponsored, endorsed or administered by, or associated with, Facebook, Instagram, TikTok or any other social media platform.

4.     Liability. Nothing in these terms excludes, restricts or modifies any right or remedy under the Australian Consumer Law that cannot be excluded. Subject to that, the Promoter is not liable for any loss, damage or injury arising from the Promotion or a prize, except to the extent caused by the Promoter's negligence.

5.     Changes. If the Promotion cannot run as planned because of an event outside the Promoter's reasonable control, the Promoter may change, suspend or end it, subject to any direction from a relevant regulator.

6.     These terms are governed by the laws of Queensland.
